Welcome to The Clinician Network ("TCN," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the TCN platform, website, and related services (the "Services"). By creating an account or using our Services, you agree to these Terms. If you do not agree, you may not use the Services.

1. Eligibility & Professional Use

TCN is a professional platform for licensed and pre-licensed mental health professionals, clinical supervisors, trainees, and behavioral health organizations. You must be at least 18 years old and legally authorized to practice in your jurisdiction to use the professional features of the Services. You are responsible for maintaining the accuracy of your professional credentials and license information.

2. Accounts

You must provide accurate, current information when creating your account
You are responsible for safeguarding your password and for all activity under your account
You may not share your account credentials or transfer your account to another person
Organization admins are responsible for managing their workforce roster and member access
We may suspend or terminate accounts that violate these Terms or applicable law

3. Subscriptions & Payments

TCN offers subscription plans for supervisors and organizations, as well as one-time purchases for training and supervision sessions. By subscribing or making a purchase:

You authorize us to charge the applicable fees to your payment method through our processor, Stripe
Subscriptions automatically renew unless cancelled before the renewal date
New subscriptions include a 7-day free trial; you may cancel during the trial at no charge
Supervision and training payments are processed via Stripe, including Stripe Connect for direct payouts to supervisors
A platform fee is applied to supervision payments processed through TCN
Refunds are handled on a case-by-case basis in accordance with our refund policy and applicable law

4. User Content & Professional Responsibility

You retain ownership of content you submit, including profile information, session notes, credentials, and training materials. You grant TCN a license to host, display, and process this content to provide the Services. You are solely responsible for:

The accuracy and legality of credentials, license numbers, and professional information you provide
Maintaining appropriate clinical supervision relationships per your jurisdiction's licensing board requirements
The content of session notes, training materials, and communications you create
Complying with HIPAA and all applicable privacy laws when handling client-protected information
Ensuring any documents uploaded do not contain protected health information (PHI) unless permitted

TCN is a hosting platform, not a board-approved continuing education provider. Clinicians are responsible for verifying that any training completed through TCN meets their state board's CE requirements.

5. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of professional licensing requirements
Misrepresent your credentials, license status, or professional qualifications
Harass, abuse, or harm other users, supervisors, or supervisees
Upload content that infringes intellectual property rights or contains malicious code
Attempt to access data or systems you are not authorized to access
Use automated tools to scrape, collect, or export data without permission
Share or distribute session notes or supervision records without proper authorization

6. Organization & Workforce Use

For users participating as members of a workforce organization: your organization admin may view your role, credential compliance status, training assignments, and supervision records for compliance and oversight purposes. Organization admins are responsible for the accuracy of roster information and for managing member access. Audit logs track administrative actions within your organization.

7. Intellectual Property

The TCN platform, including its design, features, and branding, is owned by us and protected by intellectual property laws. Training content created by providers remains the property of those providers. You may not copy, modify, or distribute platform materials without authorization.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

The platform will be uninterrupted, secure, or error-free at all times
Supervision matches will result in successful licensure outcomes
Training content meets any specific state board's CE requirements
Credential verification by organizations constitutes board-level verification

TCN facilitates connections between professionals but does not guarantee the quality, legality, or accuracy of supervision, training, or professional services provided by other users.

9. Limitation of Liability

To the maximum extent permitted by law, TCN shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold TCN harmless from claims, damages, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights, including claims related to your professional practice or supervision activities.

11. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or engage in conduct harmful to the platform or its users. Upon termination, your right to use the Services ceases, though certain professional records may be retained per our Privacy Policy and legal obligations.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or in-platform notice. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
